The law defines agrivoltaism as a solar installation located on an agricultural plot and contributing sustainably to the maintenance or development of production. The decree of April 8, 2024 specifies the conditions of this qualification.

  1. Legal definitionThe modules must contribute sustainably to the installation, maintenance or development of agricultural production.
  2. At least one direct serviceThe project must provide at least one of the following services: improvement of agronomic potential, adaptation to climate change, protection against hazards or improvement of animal welfare.
  3. Agricultural production and incomeThe installation must guarantee significant agricultural production and a sustainable income from this production.
  4. Exclusion criteriaA substantial impairment of an agricultural service or certain incompatible characteristics prevent agrivoltaic qualification.
  5. Urban planning fileThe request must include detailed justifications demonstrating compliance with agrivoltaic conditions.
  6. Monitoring over timeThe design must make it possible to measure agricultural operations and verify the conformity of the project during its operation.
